The 3D SPACE

Overview

These Terms & Conditions (“Terms”) govern the use of The 3D SPACE website and services.

By engaging our services or using our website, you agree to these Terms.

Services

The 3D SPACE provides 3D visualisation and design documentation services for design professionals and homeowners.

All services are defined by the scope agreed in writing prior to commencement of a project.

Project scope and approvals

Project scope, deliverables, timelines, and fees will be confirmed before work begins.

Any changes to scope may result in revised timelines and additional fees.

Client approval is required at key stages before final delivery.

Fees and payment

All fees are confirmed in writing prior to commencement of work.

For smaller projects, full payment is required upfront before work begins. For larger projects, a deposit is required prior to commencement, with the balance payable prior to final delivery or in staged payments where appropriate to the scope and duration of the project.

Work will not commence until the required payment has been received.

Invoices are payable within the timeframe stated on each invoice.

The Studio reserves the right to pause or withhold work and/or final deliverables where payments are overdue.

Client responsibilities

Clients agree to provide:

  • Accurate and complete project information

  • Required files, plans, and reference materials

  • Timely feedback and approvals

Delays in providing information may impact delivery timelines.

Intellectual property

All visualisations, drawings, and documentation created by The 3D SPACE remain the intellectual property of The 3D SPACE.

Upon full payment, the client is granted a non-exclusive, perpetual licence to use the deliverables for the specific project for which they were created.

This includes use for presentation, design development, approvals, and project-related marketing.

The deliverables may not be:

  • Resold

  • Licensed to third parties

  • Reused for additional projects or developments

  • Altered and redistributed outside the original project scope

without prior written consent from The 3D SPACE.

Portfolio and marketing use

The 3D SPACE reserves the right to display completed work in its portfolio, website, and marketing materials, unless otherwise agreed in writing.

Where appropriate, we may acknowledge the lead designer, architect, or project collaborator when presenting work publicly, reflecting the collaborative nature of the design process.

Revisions

Revisions are included as outlined in the agreed project scope.

Revisions beyond the agred scope will be charged additionally, based on:

  • Complexity of changes

  • Time required

  • Stage of the project at the time of request

AI use and data responsibility

The 3D SPACE may use artificial intelligence tools in a limited and controlled capacity to support internal operations, including drafting communications, research, and production support.

All AI-assisted work is reviewed, refined, and approved by a qualified team member prior to final use or delivery. AI tools are not used to generate final creative concepts, specifications, or design documentation without human oversight and professional judgement applied.

We take the security of client information seriously. Personally identifiable or sensitive information — including full names, addresses, financial details, or property access information — is not entered into AI systems unless those systems operate under a confirmed zero data retention policy or equivalent contractual data protection standard.

Client obligations regarding AI tools

All deliverables produced by The 3D SPACE — including but not limited to visualisations, drawings, documentation, specifications, schedules, and written materials — remain the intellectual property of The 3D SPACE until full payment is received and are protected under copyright law thereafter.

Clients must not input, upload, or otherwise submit any studio deliverables (in whole or in part) into any artificial intelligence system, platform, or model.

This includes but is not limited to:

  • AI image generation tools

  • Large language models

  • Design or architecture platforms with AI features

  • Any system whose terms permit the use of submitted content for training or model improvement

This restriction is in place because:

  • Many AI systems may retain or use submitted content for training or improvement

  • Submission may constitute unauthorised reproduction or distribution of copyrighted material

  • The studio cannot control or be responsible for outputs generated from third-party systems using our work

If there is any uncertainty regarding a tool or platform, clients are encouraged to seek clarification prior to use.

Breach of terms

Any breach of the Intellectual Property or AI use clauses may be treated as a material breach of these Terms and may result in termination of services and/or legal remedies where appropriate.

Limitation of liability

We are not liable for:

  • Decisions made based on visualisations or documentation

  • Construction outcomes or third-party execution

  • Delays caused by external consultants or suppliers

Website use

Content on this website is for general informational purposes only and may be updated without notice.

Termination

Either party may terminate this Agreement by providing written notice.

Where a project is terminated or cancelled by the Client:

  • The upfront payment and/or deposit is non-refundable once work has commenced or resources have been allocated to the project

  • If cancellation occurs prior to commencement of work, a reasonable administrative fee may apply to cover time spent in preparation, scheduling, or project planning

  • Any work completed up to the date of termination will be invoiced accordingly and payable by the Client

Governing law

These Terms are governed by the laws of Victoria, Australia.
